Rahul Gandhi has been sentenced to two years by the Surat district court. This punishment has been received as a case of criminal defamation is going on.
The Surat district court on March 23 sentenced senior Congress leader Rahul Gandhi to two years in jail in a 2019 criminal defamation case against him over his alleged ‘modi’ surname remarks.
He will not go to jail immediately. He has been given bail for 30 days and can file an appeal against order.
During the 2019 election, Mr Gandhi said in a rally in Karnataka that why all thieves have the surname Modi. At that time he also clarified that he was talking about diamond tycoon nirav modi and format indian premier league chief lalit modi. And asked him the question why the common surname of the thief is Modi?
After making this comment, Purnesh Modi, a lawmaker from India’s governing Bharatiya Janata Party, sued him and said that Mr. Gandhi has said this with bad intentions for the entire Modi community. But even then Rahul Gandhi said that he had no bad intentions.
Hence Rahul Gandhi was accused by IPC section 504.

The section states that who ever intentionally insult and thereby causes provocation to any person, intending to cause provocation would likely
Cause provocation or knowing that such provocation would likely cause him to break the public peace or to commit any other offense shall be punished with imprisonment for a term up to two years, or with fine, or with both.
The Maximum possible punishment under this section is two years.
However, he can appeal to the high court. If he is also convicted then the Supreme Court can also go and then the final decision will be made whether he will go to jail or not.
